  • Personal Use: You may use the Patterns for personal, non-commercial projects, including for your home or private activities.

  • Commercial Use: You may use the Patterns for commercial purposes, provided that they are incorporated into physical or digital products that are made for resale (e.g., clothing, home decor, stationery, etc.), subject to the conditions outlined in these Terms.

  2. Prohibited Uses

  You may not:

  • Resell, redistribute, or sublicense the Patterns as standalone files or as part of a larger collection of patterns or designs.

  • Use the Patterns to create products or services that infringe upon the intellectual property rights of others.

  • Modify or alter the Patterns in a way that is misleading or offensive, or that distorts the original design in a manner that harms the reputation of Whimsy By Angela.

  3. Ownership and Intellectual Property

• Please note if you resell this file/design on any website or entity and/or claim design as your own work lawful action will be taken. Please respect and share kindness to a fellow small business creative! Terms: Licensor retains all copyrights and intellectual property rights to the Pattern(s). Licensee may not claim ownership, register, or sublicense the Pattern(s) without written consent from Licensor. Licensee may not resell patterns in any shape or form. You do not own the Patterns, but are granted a limited license to use them under the conditions specified in these Terms

  4. Commercial Use Restrictions

For commercial use of the Patterns, the following restrictions apply:

• You may sell physical products that incorporate the Patterns, but you may not sell or distribute the Patterns themselves in any digital format, whether modified or unmodified.

• You may not use the Patterns in products where the design is the primary value of the item. For example, you may not create digital goods such as downloadable files or printables for resale that consist of the Pattern alone.

• You may not use the Patterns in a manner that competes directly with the Company's business.

5. Attribution and Credit

• Please send back design credits on social media or your website to @whimsybyangela or whimsybyangela.com. I would love to see what you create and help share!

• If you are using one of my designs on an end product please tag me when the item is released. If you are looking to customize one of these, create a custom design or purchase exclusivity please email me at hello@whimsybyangela.com for more information!

6. Returns and Refunds

Due to the digital nature of the Patterns, all sales are final, and no refunds will be issued after the purchase is made. If there are issues with the Pattern file, please contact us via email.

7. Limitation of Liability

By accessing or using this service, you acknowledge and agree that you are solely responsible for your actions and any legal consequences that may result from them.Whimsy By Angela does not accept responsibility for any legal action or claims that may arise from your use of our service, including but not limited to issues related to intellectual property, data protection, or third-party content. Whimsy By Angela is not responsible for any financial loss or any other type of loss that purchaser may list.

8. Indemnification

You agree to indemnify, defend, and hold harmless Whimsy By Angela and its affiliates, officers, directors, employees, agents, and representatives from any claims, damages, losses, and expenses (including legal fees) arising out of your violation of these Terms or your misuse of the Patterns.

9. Termination of License

Whimsy By Angela reserves the right to terminate or suspend your license to use the Patterns if you violate any of these Terms. Upon termination, you must cease all use of the Patterns and destroy any copies in your possession.

10. Changes to Terms

Whimsy By Angela reserves the right to modify or update these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of the Patterns after any changes to these Terms constitutes your acceptance of the modified Terms.

11. Governing Law and Dispute Resolution

By using the Patterns, you agree that no disputes or claims to these Terms, or your use of the Patterns, may be disputed, litigated, or resolved through any form of legal action, including but not limited to arbitration, mediation, or court proceedings. You acknowledge and agree that you will not initiate any legal action against Whimsy By Angela, and that you waive any right to legal recourse related to the use of the Patterns or these Terms. Any issues or disputes will be resolved solely at the discretion of Whimsy By Angela, and you agree to follow any instructions or resolutions provided.

12.Additional Files

Any requested variations beyond the original file will be charged an additional fee.
